As posted earlier, the Conservative government proposed to eliminate 280,000 applications filed before February 27th 2008 for the Federal Skilled Worker Program.
Here are some questions that you may have:
Will I be affected by the proposed changes?
Under the proposed changes, CIC would close Federal Skilled Worker applicants’ files if they:
- applied before February 27, 2008, and
- have not had a decision made by an immigration officer based on selection criteria by March 29, 2012.
It is expect this would affect around 280,000 people including dependents.
Who will not be affected by the proposed changes?
Any application that has received a file number after February 27, 2008 so you will not be affected if your file number was received after this date.
What is being done to respond to this decision by the Canadian government?
Immigration consultants are looking into a joint effort to stop the finalization of the proposal. It is expected that the changes will happen as the Conservative party holds a majority and it will receive enough votes to pass through.
There is a good chance that this issue will drag on and head to the Supreme Court. However, once or if it gets to that, it will not be for another few years as complaints against the government must go through many legal hurdles.
What options do I have if my application is removed from the backlog?
This depends on the individual applicant. Unfortunately, some applicants will not have any options under the new rules and regulations. There are currently over 60 immigration programs under both federal and provincial governments.
Will I receive a refund?
Your government application fees will be refunded. The professional fees will be treated as per the particular agreement each client has with their consulting firm.

I submitted my FSW application in Dec.2007 and recived my file no in 2008 Jan. I submiited 2nd time full info in April 2009. Again CHC asked updated info in Nov.2011 and submitted all relevent full set of documents in Dec. 2011 and Jan.2012. Further I recived my medical papers in late Dec. 2011 and completed our medicals in Jan.2012 and submitted. After that no response from CHC. When I checked with CHC – Colombo, the reply I recived is that my case is suspended due to the change of law (C-38) and asked me to look into CIC website for further information. I can not imagine on this decision of CIC even after going through medicals. Could you kindly advice me, how could I seek a relief in this regard.

If you have received your medicals, then it is likely your application will not be cancelled. Receiving your medicals means you have passed the selection criteria phase and are in the admissibility phase.

Yes, unfortunately your application is probably cancelled. If it is cancelled, as is likely, you will get the fees you paid to the government refunded to you. Yes you can resubmit your file.
It is very much pitiable that my both daughters although very much educated have gone overaged for marriage for dense desire to migrate to canada as permanent residence who had been processed continously as traind teachers who were in vast requirements but now you are relpyong in negtive. I did my medicals in April 2012 and the documents were sent immediately after. Also, they requested some updated documents such as the police certification which I got and sent to them in May. Since then, it has been all quiet and I have heard nothing about my application status. Do you have any idea how long on average does it take to get from the medical to the passport request stage? It has been 6 months now since my medicals were sent. Thanks!

I mailed my application as FSW on 08 February 2008 and the Canadian High Commission started processing my application on 28 February 2008 and the letter from the Canadian High Commission confirming receipt of my application and issuance of my file number was dated 6th March 2008. I am likely to be affected by the decision to slash the pre 2008 skilled worker application?
Given the date you provided for when processing began, you most likely will not be affected by the back-log wipe-out. The key date that determines whether an application will be affected is the date when the File Number was issued. This date will appear on the document that informed you that the application has been received/file, and that informs you of the File Number.

I have appiled for FSW in Sept 2006 from Damascus, in March 2010 my file was transfered to Warsaw. in Dec 2010 i recieved a letter to send all docs and IELTS, submitted all docs in Feb 2011 and have not heard from the office afterwards. Hi Negar, there is always a chance, but if you had not received your medical forms to fill out, then unfortunately it’s very likely your application will be among those cancelled.
My brother’s case was filed in 2006 no news was received then 2010 a Toronto lawyer was hired who charged $5,500 for the case. My brother received medical request for him and his family in 2012 and medical was duly sent. Now lawyer has received an email from immigration that my brother’s application is refused by the same law that his application was received before Feb.27, 2008 and medical was sent by mistake. Lawyer is asking again $8,000 to file an appeal. What should we do? There are few questions. We have never seen such a case that refusal is received after medical and they simply say it is a mistak? They have not mentioned anything about refund? Can their mistake be challenged in the court? My brother has lost a job because he informed his office after medical that he is going to Canada.
It seems strange that they would send a medical and then claim it was a mistake and cancel the application. We would need more information to advise you on the case. We advise you call our office about this.

I applied at New Delhi Office in APR 2006. My ECAS status suddenly changed to “Decision Made” on 25th Dec, 2012. They say the same thing as follows:
“A decision has been made on your application. The office will contact you concerning this decision soon.”
So guys please try finding out from your friends or immigration agents – what this exactly means. Approval or Rejection ????
Unfortunately for me right now that I am not in touch because I am working in Dubai right now on a Temporary Work Permit so cant get in touch properly with the VISA Office. Moreover if they send me a letter at my India address there is no one at home & my grandma dosent know how to read English so I wont know anything even if a letter arrives there. So please you guys try to find out something properly so that then maybe reading your opinions I can then take some steps further.

My case is also the same. It suddenly shows the status as Decision made. But no medicals, interviews etc…also it’s an old application pre 2008 case. Recently the online status changed to Decision made. Not sure if this means “rejection”. I am awaiting any communication from CIC. Anyone having any clues about this would be a help.
we applied on 2005 our files moved from Damascus to Warsaw so we got asked to do our medical exams in the end of 2012 does that mean we will get our visas on 2013 and finally get accepted ?? ( of course if our medical exams were good ) …
If you got your medical forms then your FSW application likely passed the selection criteria phase and will likely be completed and approved, but we can’t be certain without more details about your case.
Does that mean that most of the applications who’s status has now changed to DM who has not got their medicals is more likely to get a refund or a rejection letter ?

I have applied in 2006 and if mass applications were rejected than CIC has to refund fees with 10%

well my mom is an Oncology nurse (RN) and my dad is gonna open a restaurant there , i study Industrial & management engineer and i have a small brother and a sister who is studying child education , the amount of money they asked to show in the bank we had them triple , non of us is sick neither do have any medical problem, so do u think that what made us pass the criteria ?? mom scored 7 on the IELTS that they asked for her to do .. i really hope that we will get accepted this year since we gave our medical forms which i’m sure they will be gd .. what do u think sry i ask alot but i really need to know since i would love to study and work and live my life there to help Canada in the economy .. i wish i would get to call canada my home this year after 7 yrs of waiting :\..

My File# B0xxxxx was started in May 2005 from Buffalo, I had to return to India due to my expiry of my study permit.In early 2008 got the interview waiver letter and also paid the Right of permanence residence fees too.
Then the file was transferred to New Delhi by Buffalo for conducting the interview in few months vides their later dated. 26 March 2008. Then New delhi office assigned the new file number B0xxxxxx [FRQ].
My Question:
Why did New Delhi have to consider has new application and not process after that, file was at final decision stage?
Which date would be my Application date MAY 2005 or APRIL 2008?
According to new law state that application submitted before February 27, 2008 would be rejected, will all the application be rejected or selected application?
Recently in e-CAS status changed to Decision made stating mail would be sent to correspondonce address, With in weeks time I was not able to view any status (Blank) when I looged in e-CAS. After a weeks time I wasnt event be able to log in to e-CAS. When enquired there is technical issue with e-CAS and access was removed.
Any advice on what/how should I do.

I have applied under Simplified Process in 2007 and received a file no June, 2007 from London office with an ecas confirmation it is “In Process”.
Later on 2008 we return to Bangladesh permanently and notify my address to London office. Back in 2009, we were asked to submit all documents (education, work, bank and police clearance), we submitted everything to London office. After couple of months later we were told that our application will be processed by Singapore office as we are now living in Bangladesh and therefore, my file will be transferred to Singapore office.
Back in 2010, we received a letter from Singapore, confirming that Singapore office has received our file started processing. And we were given NEW file number.
In the middle of 2010, after the birth of our son, we have included him in our file by sending additional fees. Also time to time we updated our changes e.g. Job ranks etc.
My ECAS status was showing In process until 26th Dec, 2012. Then it turns into “Decision Made” with a forwarding msg: “A decision has been made on your application. The office will contact you concerning this decision.” Suddenly, from the 20th Jan, 2013 I am unable to access my ECAS online service.
I have already made a specific case inquiry on the 21st Jan but still no response from them. Neither we received any email nor postal letter in regards of the changes we faced after the Christmas.
Could you please put some lights on my issue from your experience? Will be really very grateful for your kind support.

Today, I tried on ecas site, and good news is i can log in and can see my name and address. but there is no link available under the “Permanent Residence Application Status ” usually there was link in process, ;later on decision made and now no link.
I am still awaiting for a response from this forum.

on end of December 2012 till today I cann’t acces on Line service of CIC.

I applied in Sept 2007 and got my file no. in Nov 2007, In 2009 i received a letter from Canadian High Commission explaining that if I am not interested in Immigration at that time I can get my fee refunded otherwise they will consider my status as interested candidate. During the period i came to know that my file has been transfered to London office and will be accordingly processed. When i heard about the policy change, i wrote an e-mail in April 2012 to the london office and asked the status and they informed me that no selection decission was made to my file and they will contact me in future, but as off know they havent contacted me as yet nor i have recieved back my fee. I have self presume that i am one of the effectee from the C-38 Law. Please Endorse.!!!
